Riqfa Bary is een 17-jarige meisje uit Ohio en heeft zich bekeerd van de islam tot het christendom. Na bedreigingen van haar vader is ze gevlucht naar Orlando. Ze was bang dat haar vader haar 'zou moeten verwijderen' zoals de 'erecode' of sharia nu eenmaal vereist. Momenteel wordt in Orlando onderzocht of Riqfa terug kan keren naar haar ouders in Ohio, wat feitelijk verstoting en misschien een doodvonnis zou betekenen.

Update: Rechter Daniel Dawson heeft besloten dat Fathima Rifqa Bary voorlopig niet hoeft terug te keren naar haar ouders in Ohio. De kinderbescherming kon aantonen dat ze meerdere malen is bedreigd, contact heeft gezocht met haar dekaan op school en andere hulpverleners voordat ze via facebook in contact kwam met de kerkelijke organisatie in Florida.

Rifqa Bary has less rights than a captured Al-Qaeda terrorist September 04, 2009
One of the bombshell developments from yesterday's hearing in Florida family court in the case of would-be honor killing victim Rifqa Bary is that the Florida Dept of Law Enforcement (FDLE) conducted a three and a half hour interrogation WITHOUT HER ATTORNEYS present - showing that Rifqa has less rights than a captured Al-Qaeda terrorist in Guantanamo Bay. The only thing FDLE stopped short of was waterboarding Rifqa.

Rifqa's court-appointed advocate/guardian ad litem was livid as she had requested that the Dept of Children and Families (DCF) notify her and Rifqa's personal attorney before an interrogation, which never happened. DCF and FDLE - both controlled by FL Gov. Charlie Crist - colluded to make this inquisition happen in the absence of her attorneys.

According to news reports, the guardian ad litem said that 15 minutes into the interview, Rifqa asked about having her attorneys present at which point the three adult male FDLE inquisitors told her that since she was the "victim" in the case, she wasn't entitled to have her attorneys present. Needless to say, her abusive parents had their attorneys present during their interview.

Er is een goede kant aan de zaak: rechters zullen niet zo gauw nu Rifqa naar haar ouders sturen. Er zijn wel ouders voor minder uit de ouderlijke macht ontzet.

Latest on Rifqa Bary case: bad and good news?
First, here's the rotten news. The judge has decided that Rifqa can be sent back to Ohio, where the authorities have greased the wheels to return her to her abusive family to appease the alter of political correctness.

However, the judge did throw one wrinkle into the mix:

Before the girl gets sent back, the judge says he needs immigration papers proving her status in the U.S. and proof from the state of Florida that she can continue her virtual schooling and receive credit in Ohio.

Indeed, as the Jawa Report notes, the parents and their lawyers have refused at least five times to provide immigration documents. It appears they may be in the US illegally, and managed to get a visa to enter originally by using Rifqa eye injury, something I hadn't fully taken notice of before, to get treatment but overstayed their visa. So there may be more here than meets the eye, and another thing: if they're in the US illegally, it means they were making money off of people in the jewelry business without the proper license.

Update: here's more from Atlas Shrugs on the court hearing. You know, I suppose I will have to give the judge some credit here for understanding the importance of the issues regarding the missing legal documents. And just look at how the parents' lawyer, Shaytan Elahi, popped his cork and was pretty irrational/absurd in his accusations against the defense team.

ATLAS EXCLUSIVE BREAKING Mohamed Bary's Missing Immigration Documents: Status ILLEGAL
The Barys have ten days before they are in contempt of court. My money says they are going to say the documents are lost.

Perhaps the Barys have not provided the documents because they are here illegally, as these Department of Homeland Security documents show.

Yesterday Judge Daniel Dawson laid down the law and said in no uncertain terms that Rifqa would not be returned to Ohio until the immigration docs were produced.

Shayan "Shaytan" Elahi claimed yesterday that there were no docs to submit. The judge said they got into this country, he wants that paperwork. Apparently only two pages of Aysha's passport were submitted.

Judge Dawson insisted, "the court would feel lot better if these documents were here, before it gives up jurisdiction." And Rifqa's GAL Krista Bartholomew said that Rifqa Bary runs the risk of deportation if she takes public transportation anywhere in this country.

Elahi got very nasty with the judge when he insisted on getting the immigration paperwork. "You and your client didn't supply it. I want it before this child leaves Florida," said Dawson.

Elahi accused Rifqa's attorney, John Stemberger, of "religious predatory practices" and accused Stemberger of wanting to kidnap her, "squirrel her away".

Bottom line, Dawson said it is the parents' fault for not getting the immigration documentation. He doesn't plan to release her until he sees it.

Bary has been in the United States illegally since the date of his entry, and until now. He is an illegal alien, subject to deportation and further exclusion. Simple as that.
